1. General provisions

These Terms of Use ('Terms') govern the relationship between the company Qenlito d.o.o. (OIB: 48293017562), with its registered office in Zagreb, Vukovarska ulica 34, 10000 Zagreb ('Qenlito', 'we') and users of the qenlito.com platform ('User', 'you'). By using our platform, you accept these Terms in their entirety.

The qenlito.com platform is intended for real estate crowdfunding in the Republic of Croatia. It is regulated by the Croatian Financial Services Supervisory Agency (HANFA) in accordance with applicable regulations.

2. Definitions

'Platform' refers to the website qenlito.com and all related services. 'Project' refers to a construction or development real estate project available for investment through the Platform. 'Investment' refers to the financial contribution of a User to a specific Project. 'Profit' refers to the financial return resulting from the successful completion of a Project.

3. Platform usage

To use the Platform, you must be at least 18 years old and have the legal capacity to enter into contracts. During registration, you are obliged to provide accurate and up-to-date information. You are responsible for the confidentiality of your account access credentials.

We reserve the right to refuse registration or suspend the account of any user who violates these Terms or applicable regulations.

4. Investment risks

Investing in real estate through crowdfunding carries inherent risks, including the possibility of losing part or all of the invested capital. Past results do not guarantee future returns. The value of investments can increase or decrease.

Before investing, we recommend that you carefully review all available information about the project, including risk assessment, financial projections, and participation terms. Qenlito does not provide investment advice nor guarantees investment returns.

5. Fees

Qenlito may charge fees for using the Platform. All applicable fees will be clearly displayed before any investment. Detailed fee information is available in the description of each individual project.

6. Intellectual property

All content on the Platform, including texts, graphics, logos, images, and software code, is protected by copyright and is the property of Qenlito d.o.o. or its licensors. Copying, distribution, or use of content without prior written consent is prohibited.

7. Limitation of liability

Qenlito strives to ensure the accuracy of all information on the Platform but does not guarantee the completeness or timeliness of content. We are not liable for losses arising from investments, technical interruptions, or actions of third parties. Our total liability is limited to the amount of fees you have paid us in the last twelve months.

8. Applicable law and jurisdiction

These Terms are interpreted and applied in accordance with the law of the Republic of Croatia. The court in Zagreb has jurisdiction over all disputes arising from these Terms.

9. Changes to terms

We reserve the right to amend these Terms at any time. We will notify you of significant changes through the Platform or by email at least thirty days before they take effect. Continued use of the Platform after the amended Terms take effect will be deemed your acceptance thereof.
